  • Kuigi EL ametlikes dokumentides tähendab termin „refugee“ umbes 95% juhtudel sõna „pagulane“, siis mõnikord võib siiski juhtuda, et ingliskeelses dokumendis peetakse silmas sõna „refugee“ laiemat tähendust kui lihtsalt Genfi 1951. a pagulasseisundi konventsioonis sisalduvat pagulase mõistet ja sellistel harvadel juhtudel tuleks „refugee“ tõlkida eesti keelde kui „põgenik“

  • (1) Pagulane on välismaalane, kes põhjendatult kartes tagakiusamist rassi, usu, rahvuse, poliitiliste veendumuste või sotsiaalsesse gruppi kuulumise pärast viibib väljaspool päritoluriiki ega suuda või kartuse tõttu ei taha saada nimetatud riigilt kaitset ning kelle suhtes ei esine pagulasena tunnustamist välistavat asjaolu. Tagakiusamise hindamisel ei ole oluline, kas välismaalasel reaalselt on käesolevas lõikes nimetatud tagakiusamise alus, vaid üksnes tagakiusamise asjaolu.

  • (1) A refugee is an alien who, owing to a well-founded fear of being persecuted for reasons of race, religion, nationality, political opinion or membership of a particular social group, is outside the country of nationality and is unable or, owing to such fear, is unwilling to avail himself or herself of the protection of that country and with regard to whom no circumstance exists precluding recognition as a refugee. Upon assessing persecution it does not matter whether the alien has a real basis for persecution specified in this subsection or only the circumstance of persecution.
