For three years from the first day of the month following that in which he ceases to hold office, a former member of the Commission or of the Court shall receive a monthly transitional allowance equal to 40 % of the basic salary which he was receiving when he ceased to hold office if he has served for less than two years, to 45 % of such basic salary if he has served for more than two but less than three years and to 50 % in other cases.
