  • § 146. Erirežiim (1) Erirežiim on makseraskustes oleva või Finantsinspektsiooni hinnangul finantsseisundi tõttu tõenäoliselt makseraskustesse sattuva Eesti kindlustusandja või kolmanda riigi kindlustusandja Eesti filiaali esindamiseks või tema tegevuseks kehtestatud tavalisest erinev kord, mille eesmärk on välja selgitada makseraskuste põhjused ja iseloom ja maksevõime taastamise võimalused ning võtta tarvitusele abinõud kindlustusvõtjate, kindlustatute ja soodustatud isikute huvide kaitsmiseks.

Special regime (1) A special regime is a procedure established for the representation or activities of an Estonian insurance undertaking or an Estonian branch of a third country insurance undertaking which due to its financial condition is experiencing, or in the opinion of the Financial Supervision Authority, is likely to experience solvency problems, which differs from the usual procedure and the objective of which is to ascertain the reason and nature of the solvency problems, and the possibilities to restore solvency, and to take measures to protect the interests of the policyholders, insured persons and beneficiaries.
