  • Any person making a request for information to a public authority is entitled - (a) to be informed in writing by the public authority whether it holds information of the description specified in the request, and (b) if that is the case, to have that information communicated to him.
  • Without prejudice to Articles 21 and 22 of the EC Statute, Articles 24 and 25 of the ECSC Statute and Articles 22 and 23 of the EAEC Statute, the following measures of inquiry may be adopted: (a) the personal appearance of the parties; (b) a request for information and production of documents; (c) oral testimony; (d) the commissioning of an expert's report; (e) an inspection of the place or thing in question.

Good to know
  • The term Request for Information (RFI) is used to describe an intelligence requirement that is passed to the intelligence requirements manager at higher, lower or adjacent levels. A RFI is used when a commander does not have sufficient allocated collection capabilities or the intelligence staff is unable to answer a question through research or other means, and thus the commander requires assistance from a superior or adjacent command. The receiving organization will treat the incoming RFI as an intelligence requirement, the only difference being that the intelligence requirement is undertaken on behalf of another organization. A single intelligence requirement may generate a number of separate RFIs for different providers or other intelligence resources such as national assets or subordinate headquarters.
