  • (2) Tagatistasu käesoleva seaduse tähenduses on rahasumma, mille tagatise saaja tasub sihtasutusele tagatislepingus määratud suuruses ja tähtajal. Tagatistasu peab katma sihtasutuse laenude tagamisega seotud kulud ja võimaliku kahju pikema perioodi vältel, vastama tagatavatele riskidele ning tagatislepingust tulenevale tagatise summale ja tagatise saaja omavastutuse ulatusele.
