  • Tulumaksuga maksustatakse kõik tasud, mida makstakse töötajale, avalikule teenistujale või kaitseväeteenistujale, sealhulgas palk, lisatasu, juurdemakse, puhkusetasu või puhkusetoetus, töölepingu lõpetamisel või teenistusest vabastamisel ettenähtud hüvitis, kohtu või töövaidluskomisjoni poolt väljamõistetud hüvitis või viivis, Eesti Vabariigi puhkuseseaduse (RT 1992, 37, 481; 1993, 10, 150; RT I 1994, 84, 1474; 1995, 16, 228; 1997, 74, 1229; 93, 1560; 1999, 82, 749) § 31 alusel riigi poolt hüvitatav tasu täiendavate puhkusepäevade eest, samuti spordiseaduse (RT I 1998, 61, 982) § 13 lõikes 2 nimetatud lepingute alusel sportlasele makstav tasu. Avalik teenistuja käesoleva seaduse tähenduses on ka avaliku teenistuse seaduse (RT I 1995, 16, 228; 1999, 7, 112; 10, 155; 16, 271 ja 276) § 12 lõigetes 2 ja 3 nimetatud teenistuja.
