...a Community plant variety right as an object of property shall be regarded in all respects, and for the entire territory of the Community, as a corresponding property right in the Member State in which: (a) according to the entry in the Register of Community Plant Variety Rights, the holder was domiciled or had his seat or an establishment on the relevant date; or (b) if the conditions laid down in subparagraph (a) are not fulfilled, the first-mentioned procedural representative of the holder,a s indicated in the said Register, was domiciled or had his seat or an establishment on the date of registration.
