Komisjonilepinguga kohustub üks isik (komisjonär) teise isiku (komitent) jaoks oma nimel ja komitendi arvel tegema tehingu, eelkõige müüma komitendile kuuluva eseme või ostma komitendile teatud eseme (komisjoniese). Komitent kohustub komisjonärile maksma selle eest tasu (komisjonitasu).
