  • Lepingulist kohustust rikkunud lepingupool võib rikkumise oma kulul heastada, muuhulgas mittekohase täitmise parandada või asendada, kuni teine lepingupool ei ole lepingust taganenud, seda üles öelnud või nõudnud kohustuse täitmise asemel kahju hüvitamist, kui: 1) heastamine on vastavalt asjaoludele mõistlik ja 2) heastamisega ei põhjustata kahjustatud lepingupoolele põhjendamatuid ebamugavusi ega- kulutusi ja 3) kahjustatud lepingupoolel ei ole õigustatud huvi heastamisest keelduda.
