By way of derogation from Article 3 (1), Member States may authorize the marketing and use, within their own territory, of: ... (b) additives belonging to groups other than those listed in Annex I or Annex II, provided that tests have shown that the conditions set out in Article 7 (2) (A) are satisfied. This derogation shall not apply to substances having a hormonal or anti-hormonal effect.
