workers who hold implicit or explicit contracts of employment where the timing and duration of the contract is significantly influenced by seasonal factors such as the climatic cycle, public holidays and/or agricultural harvests, any employed person who goes to the territory of a Member State other than the one in which he is resident to do work there of a seasonal nature for an undertaking or an employer of that State for a period which may on no account exceed eight month, and who stays in the territory of the said State for the duration of this work; work of a seasonal nature shall be taken to mean work which, being dependent on the succession of the seasons, automatically recurs each year, välismaalane, kelle alaline või peamine elukoht on kolmandas riigis ning kes viibib Eestis käesoleva seaduse § 43 lõike 1 punktis 1, 2 või 4 nimetatud alusel ning teeb hooajatööd Eestis registreeritud tööandjaga sõlmitud tähtajalise töölepingu alusel, kolmanda riigi kodanik, kelle peamine elukoht on kolmandas riigis ning kes viibib seaduslikult ajutiselt liikmesriigi territooriumil, tehes hooajalisusest sõltuvat tööd ühe või mitme tähtajalise töölepingu alusel, mis on sõlmitud otse asjaomase kolmanda riigi kodaniku ja asjaomases liikmesriigis asutatud tööandja vahel
