Õigustatud isikud. (1) Õigus taotleda tasu maksmise kohustuse ülevõtmist on: 1) alaealisel isikul; 2) alates 18. eluaastast tööealisel isikul, kellel on puue puuetega inimeste sotsiaaltoetuste seaduse § 2 tähenduses või kellel on tuvastatud osaline või puuduv töövõime töövõimetoetuse seaduse alusel; 3) riikliku pensionikindlustuse seaduse §-s 7 sätestatud vanaduspensioniikka jõudnud isikul.
Õigustatud isikule hüvitise maksmise otsustamine. Otseselt kaasneva varalise kahju ja saamata jääva tulu eest rentnikule, üürnikule ja piiratud asjaõiguse omajale hüvitise maksmise otsustab isik, kelle pädevuses on kinnisasja omandamise otsustamine.
Abikaasa on õigustatud isikute järjestuses võrdsustatud alaealise lapsega ning ta saab ülalpidamist enne täiskasvanud last või abielus olevat alaealist last ja ülejäänud sugulasi.
