Upon application by the undertakings or associations of undertakings concerned, the Commission may certify that, on the basis of the facts in its possession, there are no grounds under Article 85 (1) or Article 86 of the treaty for action on its part in respect of an agreement, decision or practice., a certification from the EU Commission that the transaction is not in violation of Article 85(1) or satisfies the requirements of a block exemption.
