Välisriigi laeva läbisõitu territoriaalmerest loetakse rahumeelseks, kui see läbisõit ei ohusta Eesti julgeolekut ega riku Ühinenud Rahvaste Organisatsiooni 1982. aasta mereõiguse konventsiooniga kehtestatud rahumeelse läbisõidu korda.
Passage means navigation through the territorial sea for the purpose of: (a) traversing that sea without entering internal waters or calling at a roadstead or port facility outside internal waters; or (b) proceeding to or from internal waters or a call at such roadstead or port facility. Passage is innocent so long as it is not prejudicial to the peace, good order or security of the coastal State. Such passage shall take place in conformity with this Convention and with other rules of international law.
... operating means catching or catching and processing fish or other living resources of the sea without prejudice to the right of innocent passage in the territorial sea and the freedom of navigation in the 200 mile exclusive economic zone.
Le passage est inoffensif aussi longtemps qu'il ne porte pas atteinte ? la paix, au bon ordre ou ? la sécurité de l'État c?tier. Il doit s'effectuer en conformité avec les dispositions de la convention et les autres règles du droit international.
