fundamental freedom of Union citizens and one of the pillars of the internal market in the Union enshrined in Article 45 of the Treaty on the Functioning of the European Union (TFEU)
1. Tagatakse töötajate liikumisvabadus liidu piires.
2. Selline liikumisvabadus nõuab igasuguse kodakondsusel põhineva liikmesriikide töötajate diskrimineerimise kaotamist nii töölevõtmisel, töö tasustamisel kui ka muude töötingimuste puhul.
Euroopa Liidu ja Euroopa Majanduspiirkonna liikmesriigi kodanikust töötaja või ametnik ja tema perekonnaliige, kes leiab, et ta on kannatanud või kannatab töötajate vaba liikumise õiguse teostamise põhjendamatute piirangute ja takistuste tõttu või et teda on võrdse kohtlemise põhimõtte kohaldamata jätmise tõttu õigusvastaselt koheldud, isegi kui selline töösuhe, millega kaasnes väidetav piiramine, takistamine või diskrimineerimine, on lõppenud, võib kasutada kõiki õiguskaitsevahendeid samadel alustel ja ulatuses nagu Eesti kodanik.
Töötuna ja tööotsijana arvel olevate isikute ning tööturuteenuste osutamise registrit (edaspidi register) peetakse tööturuteenuste osutamise ja -toetuste maksmiseks tööealise elanikkonna võimalikult kõrge tööhõive määra saavutamise ning pikaajalise töötuse ja tööturult tõrjutuse ennetamiseks, töötajate vaba liikumise soodustamiseks, töökoha täitmiseks välismaalasega loa andmiseks, sotsiaalmaksu erijuhtudel maksmiseks ning statistika ja analüüside tegemiseks vajalike andmete tagamiseks.
Freedom of movement for workers should be secured within the Union. The attainment of this objective entails the abolition of any discrimination based on nationality between workers of the Member States as regards employment, remuneration and other conditions of work and employment, as well as the right of such workers to move freely within the Union in order to pursue activities as employed persons subject to any limitations justified on grounds of public policy, public security or public health.
The free movement of workers is also a key element in the development of a genuine Union labour market, allowing workers to move to areas where there are labour shortages or more employment opportunities, helping more people find posts which are better suited to their skills and overcoming bottlenecks in the labour market.
The free movement of workers gives every citizen of the Union, irrespective of his or her place of residence, the right to move freely to another Member State in order to work there and/or to reside there for work purposes. It protects them against discrimination on grounds of nationality as regards access to employment, conditions of employment and work, in particular with regard to remuneration, dismissal, and tax and social advantages, by ensuring their equal treatment, under national law, practice and collective agreements, in comparison to nationals of that Member State.
