Directive 85/374/EEC defines the concept of damage caused by defective products. It is damage caused by death or personal injury and damage to or destruction of property which is ordinarily intended for private use and actually mainly used by the injured person for private use. A claim cannot be made for damage to the defective product itself. It may also be possible, depending on the law of the particular Member State concerned, to seek compensation for non-material damage.

In Recital 15 of the definitive duty Regulation it was concluded that 'the cumulated dumped imports from Japan, the People's Republic of China, the Republic of Korea and Thailand had caused material injury to the Community industry'.
