In the sole case of default under a loan contracted pursuant to Council Regulations and Decisions, in circumstances in which the Commission cannot activate other measures provided for by the financial arrangements applying to these loans in time to ensure compliance with the Community's legal obligations to its lenders, the provisions of paragraphs 2 and 4 may provisionally be applied, irrespective of the conditions in paragraph 2 in order to service the Community's debts.
