Riigikohtu esimees Rait Maruste:
„Kohtunik ei saa võtta süüdistavat positsiooni, hakata süüdistuskokkuvõtet ette lugema, kui protsessil prokuröri lihtsalt ei ole. Seda juhtub küllalt sageli. Pealegi, kuidas me saame jälgida, et riigivõim toimiks talle ette antud raamides, kui kohus ehk neutraalne kontrolliorgan võtab riigivõimu ülesande samuti enda kanda? Minu arvates ei ole see kooskõlas ka Euroopa inimõiguste ja põhivabaduste kaitse konventsiooniga, mis rajaneb võistlevuse põhimõttel.“
