Välisriigi laeva peatusteta rahumeelne läbisõit Eesti territoriaalmerest on lubatud. Välisriigi laeva läbisõitu territoriaalmerest loetakse rahumeelseks, kui see läbisõit ei ohusta Eesti julgeolekut ega riku Ühinenud Rahvaste Organisatsiooni 1982. aasta mereõiguse konventsiooniga kehtestatud rahumeelse läbisõidu korda.
Ühineda juurdelisatud Ühinenud Rahvaste Organisatsiooni 1982. aasta 10. detsembri mereõiguse konventsiooni XI osa rakenduskokkuleppega, mis on koostatud 1994. aasta 28. juulil New Yorgis.
The United Nations Convention on the Law of the Sea and the Agreement relating to the implementation of Part XI of the Convention shall apply, with regard to the competences transferred to the European Community, to the territories in which the Treaty establishing the European Community is applied and under the conditions laid down in that Treaty, in particular Article 227 thereof.
