  • The judgment on an uncontested claim (the "Judgment") must be certified as a European enforcement order by the Member State of origin in accordance with certain conditions. The certification may apply to only parts of the judgment, in which case the order will be known as a "partial European enforcement order". Certification is carried out by means of the standard form attached to this proposal. This form avoids translation costs in the vast majority of cases. There is no provision for an appeal against the decision on certification. If the "Judgment" is not yet deemed to have the authority of a final decision, a specific enforcement order may be granted so that the creditor may request precautionary measures to be taken as regards the debtor's property.
