Imporditud põllumajandussaadustele ja -toodetele, millele on Vabariigi Valitsuse poolt seaduse alusel kehtestatud miinimumhind, on väikseimaks maksustatavaks väärtuseks see miinimumhind koos kõigi impordimaksudega, välja arvatud käesolev maks.
Juhul, kui ei peeta kinni ühest nendest kriteeriumidest, on Ühendusel õigus rakendada meetmeid, mis tagavad minimaalhinna iga Eestist imporditud kaubakoguse puhul.
