  • (2) Ebaaus konkurents on ebaaus äritegevus ning heade kommete ja tavadega vastuolus olevad teod, sealhulgas: 1) eksitava teabe avaldamine, avaldamiseks esitamine ja tellimine ning konkurendi või tema toote või teenuse (edaspidi kaup) halvustamine; 2) ärisaladuse ebaseaduslik saamine, kasutamine ja avaldamine; 3) konkurendi töötaja või esindaja ärakasutamine.

  • (2) Unfair competition is taken to mean dishonest trading practices and acts which are contrary to good morals and practices, including: 1) disclosure of misleading information, presentation and ordering of misleading information for disclosure and disparagement of a competitor or the product or service (hereinafter goods) of the competitor; 2) unlawful acquisition, use and disclosure of a business secret; 3) misuse of an employee or representative of a competitor.
