  • (4) Suitsetamistubakas käesoleva seaduse mõistes on: 1) tarbimisvalmiks töödeldud tubakas, mis on peeneks lõigatud või muul viisil purustatud või mis on keeratud või pressitud kangideks ja on suitsetamiskõlblik täiendava töötlemiseta; 2) jaemüüki suunatud tubakajäätmed, mis ei kuulu käesoleva paragrahvi lõigetes 2, 3 ja 31 nimetatud toodete hulka ja mida on võimalik suitsetada. Tubakajäätmed käesoleva lõike mõistes on tubakalehtede jäägid ja tubaka töötlemisel või tubakatoodete tootmisel tekkivad kõrvalsaadused; 3) jaemüüki suunatud töödeldud või töötlemata tubakas, mis on suitsetamiskõlblik. Tubakas, välja arvatud kasvav taim, ja tubakajäätmed loetakse jaemüüki suunatuks, kui neid ladustatakse väljaspool aktsiisiladu.
  • (41) Sigarettideks keeratavaks suitsetamistubakaks loetakse suitsetamistubakat, mille kaalust moodustavad rohkem kui 25 protsenti tubakaosakesed ristlõikega alla 1,5 millimeetri. Sigarettideks keeratavaks suitsetamistubakaks loetakse ka suitsetamistubakat, mille kaalust moodustavad rohkem kui 25 protsenti tubakaosakesed ristlõikega üle 1,5 millimeetri ja mida müüakse sigarettideks keeramiseks.
  • (6) Toodet, mis koosneb täielikult või osaliselt ainetest, mis ei ole saadud tubakast, aga muus osas vastab käesoleva paragrahvi lõikes 3 või 4 sätestatule, käsitatakse vastavalt sigaretina või suitsetamistubakana.

  • (4) For the purposes of this Act, ‘smoking tobacco’ means: 1) fine-cut or otherwise split tobacco, twisted or pressed into blocks and is capable of being smoked without further processing; 2) tobacco refuse put up for retail sale which does not fall under products specified in subsections 2, 3 and 31 of this section and which is capable of being smoked. For the purpose of this section, ‘tobacco refuse’ is deemed to be remnants of tobacco leaves and by-products obtained from tobacco processing or the manufacture of tobacco products; 3) processed or unprocessed tobacco put up for retail sale, which is capable of being smoked. Tobacco, except for the growing plant, and tobacco refuse is deemed to be put up for retail sale in case they are stored outside of an excise warehouse;
  • (41) Smoking tobacco in which the tobacco particles with a cut width of less than 1.5 millimetres make up more than 25% by weight is deemed to be smoking tobacco for the rolling of cigarettes. Smoking tobacco in which the tobacco particles with a cut width of more than 1.5 millimetres make up more than 25% by weight and which is sold for the rolling of cigarettes, is also deemed to be smoking tobacco for the rolling of cigarettes.
  • (6) A products consisting in whole or in part of substances other than tobacco but otherwise conforming to the provisions of subsection 3 or 4 of this section is treated as a cigarette or smoking tobacco respectively.
