(1) Teadus- ja arendusasutus on juriidiline isik või asutus, mille: 1) põhitegevus on alusuuringute, rakendusuuringute või arendustegevuse või mitme nimetatud tegevuse läbiviimine; 2) põhitegevusega kaasnevaks tegevuseks on levitada teadmisi õpetamise, publitseerimise või tehnoloogiasiirde kaudu; 3) liikmeskonda kuuluvad põhitegevuseks vajalike alus- ja rakendusuuringute või arendustegevusega tegelevad akadeemilised töötajad ning teised teadus- ja arendustegevusega seotud töötajad; 4) hooned, ruumid, sisustus ja muu vara on piisavad ning sobivad põhitegevuse läbiviimiseks; 5) riigieelarvelistest vahenditest finantseeritud põhitegevuse tulemused, millega ei kaasne intellektuaalomandiõigused, on avalik teave; 6) käesoleva lõike punktides 1 ja 2 nimetatud tegevuste tulemustest, sealhulgas intellektuaalomandiõigustest saadud kasum, investeeritakse teadus- ja arendustegevusse, selle tulemuste levitamisse või õpetamisse; 7) majandustegevus (toodete ja teenuste pakkumine teataval turul) ja käesoleva lõike punktides 1 ja 2 nimetatud tegevused, mis vastavad punktide 5 ja 6 nõuetele (mittemajanduslik tegevus), nende kulud ja rahastamine on teadus- ja arendusasutuse raamatupidamises selgelt eristatud., (1) A research and development institution is a legal person or an institution in the case of which: 1) the principal activity is carrying out basic research, applied research or development, or several of the aforementioned activities; 2) the activity accompanying the principal activity is to spread knowledge through teaching, publication or technology transfer; 3) the membership includes academic staff engaged in basic research, applied research or development required for the principal activity as well as other staff involved in research and development; 4) the rooms, buildings, furnishings and other property are sufficient and suitable for carrying out the principal activity; 5) the results of the principal activity financed from the state budget funds which do not involve intellectual property rights are public information; 6) any profit from the results of the activities specified in clauses 1 and 2 of this subsection, including from intellectual property rights, is invested in research and development, the spreading of the results thereof or in teaching; 7) the economic activity (offering of products and services on a certain market) and the activities specified in clauses 1 and 2 of this subsection which comply with the requirements set out in clauses 5 and 6 (non-economic activity), and the expenses and financing thereof are clearly separated in the accounting of the research and development institution., defineeritakse kõikide Eesti õigusaktide ulatuses, defined within the scope of all Estonian legal instruments, kehtib kuni 01.10.2025, in force until 01.10.2025
