  • § 147. Saneerimismeetmed (1) Saneerimismeetmed käesoleva seaduse tähenduses on teise lepinguriigi haldusasutuse või kohtu toimingud, mille eesmärk on säilitada või taastada selle lepinguriigi kindlustusandja või selles lepinguriigis asutatud kolmanda riigi kindlustusandja filiaali maksevõime ning mis võivad mõjutada kolmandate isikute varasemaid õigusi ja millega võib kaasneda kindlustushüvitiste, muude maksete või täitemenetluse peatamine või nõuete vähendamine.

Reorganisation measures (1) For the purposes of this Act, reorganisation measures shall mean acts by an administrative authority or court of another Contracting State taken with the objective to maintain or restore the solvency of an insurance undertaking of the corresponding Contracting State or a branch of a third country insurance undertaking established in the corresponding Contracting State, which may affect the pre-existing rights held by third parties and which may involve the suspension of payment of insurance indemnities, making of other payments or enforcement proceeding, or the reduction of claims.

  • (1) Tervendamismeetmed käesoleva seaduse tähenduses on teise lepinguriigi haldusasutuse või kohtu vastava menetluse (tervendamismenetlus) käigus läbi viidavad toimingud, mille eesmärk on säilitada või taastada vastava lepinguriigi krediidiasutuse ja tema filiaali või selles lepinguriigis asutatud kolmanda riigi krediidiasutuse filiaali maksevõime ning mis võivad mõjutada kolmandate isikute varasemaid õigusi või millega võib kaasneda maksete ja täitemenetluse peatamine või nõuete vähendamine. Tervendamismeetmetena käsitatakse ka finantskriisi ennetamise ja lahendamise seaduses sätestatud Finantsinspektsiooni või muude pädevate ametiasutuste rakendatavaid kriisilahendusmeetmeid ja -õigusi.

  • (1) For the purposes of this Act, reorganisation measures are acts performed in the course of corresponding proceedings (reorganisation proceedings) of an administrative authority or court of another contracting state with the objective to preserve or restore the solvency of the credit institution of the corresponding contracting state or a branch thereof, or a branch founded in that contracting state by a third country credit institution, and which may affect earlier rights of third parties or result in suspension of payments or execution proceedings, or reduction of claims. Crisis resolution measures and rights provided for in the Financial Crisis Prevention and Resolution Act and implemented by Financial Supervision Authority or other competent authorities are also deemed as reorganisation measures.
