  • (1) Toode käesoleva seaduse tähenduses on Euroopa Parlamendi ja nõukogu määruse (EL) 2019/1020 turujärelevalve ja toodete vastavuse kohta ning millega muudetakse direktiivi 2004/42/EÜ ja määruseid (EÜ) nr 765/2008 ja (EL) nr 305/2011 (ELT L 169, 25.06.2019, lk 1–44), kohaldamisalasse jääv toode.
  • (2) Käesoleva seaduse tähenduses on toode muu hulgas ka vallasasi, mis on mõeldud tarbijale või mida tarbija võib eeldatavalt mõistlikul viisil kasutada ka juhul, kui see ei ole tarbijale ette nähtud, samuti teenuse osutamise korral tarbijale kättesaadavaks tehtud toode, mida tasu eest või tasuta pakutakse või tehakse kättesaadavaks majandus- või kutsetegevuse käigus, sõltumata sellest, kas toode on uus, kasutatud või parendatud.

  • (1) For the purposes of this Act, ‘product’ means a product that falls within the scope of application of Regulation (EU) 2019/1020 of the European Parliament and of the Council on market surveillance and compliance of products and amending Directive 2004/42/EC and Regulations (EC) No 765/2008 and (EU) No 305/2011 (OJ L 169, 25.06.2019, pp 1–44).
  • (2) For the purposes of this Act, ‘product’ also means, among other things, a movable that is intended for consumers or that consumers may use in a presumably reasonable manner even where not intended for them, as well as any product that is made available to consumers in the context of providing a service, that is supplied or made available, whether for consideration or not, in the course of commercial or professional activity, and regardless of whether the product is new, used or reconditioned.
