  • Officials other than those in Grades A 1 and A 2 shall serve a probationary period before they can be established. The period shall be nine months for officials in Category A, in the Language Service or in Category B, and six months for other officials. Not less than one month before the expiry of the probationary period, a report shall be made on the ability of the probationer to perform the duties pertaining to his post and also on his efficiency and conduct in the service. This report shall be communicated to the person concerned, who shall have the right to submit his comments in writing. A probationer whose work has not proved adequate for establishment in his post shall be dismissed.

  • § 2. Kriminaalhooldusalune Kriminaalhooldusalune on: 1) süüdimõistetu, kelle kohus on seaduses sätestatud korras määranud kriminaalhooldaja järelevalve alla; 2) süüdimõistetu, kelle vangistus on asendatud üldkasuliku tööga või narkomaanide sõltuvusraviga või osaliselt asendatud seksuaalkurjategijate kompleksraviga; 3) isik, kelle suhtes on kriminaalmenetlus lõpetatud ning kellele on prokurör või kohus määranud üldkasuliku töö tegemise või kohustuse alluda karistusseadustiku § 751 lõikes 1 sätestatud alkoholi tarvitamise keelu täitmist kontrolliva elektroonilise seadme valvele; 4) kahtlustatav või süüdistatav, kellel tõkendina kohaldatud vahistamine on asendatud elektroonilisele valvele allumise kohustusega; 5) kahtlustatav, süüdistatav või süüdimõistetu, kellele kohus on kohaldanud elektroonilise valvega ajutist lähenemiskeeldu või lähenemiskeeldu; 6) süüdlane, kelle arest on asendatud üldkasuliku tööga või kellele kohus on määranud üldkasuliku töö tegemise kohustuse karistusseadustiku § 87 alusel; 7) kahtlustatav või süüdistatav, kelle kohta on prokurör või kohus tellinud kohtueelse ettekande.

Probationer A probationer is: 1) a convicted offender whom a court has placed under the supervision of a probation supervisor pursuant to the procedure provided by law; 2) a convicted offender whose imprisonment has been substituted by community service or addiction treatment or partially substituted by complex treatment of sex offenders; 3) a person with regard to whom criminal proceedings have been terminated and who has been imposed community service by a prosecutor or court or an obligation to submit to surveillance of compliance with prohibition on consumption of alcohol by an electronic device provided for in subsection 1 of § 751 of the Penal Code; 4) a suspect or accused upon whom taking into custody imposed as a preventive measure has been substituted by obligation to submit to electronic surveillance; 5) a suspect, accused or offender upon whom the court has imposed a temporary restraining order with electronic surveillance or a restraining order; 6) an offender whose detention has been substituted by community service or on whom a court has imposed the community service obligation pursuant to § 87 of the Penal Code; 7) a suspect or accused on whom a prosecutor or court has ordered a pre-trial report.
