A supplier shall not be penalized if a tender is received in the office designated in the tender documentation after the time specified because of delay due solely to mishandling on the part of the entity. Tenders may also be considered in other exceptional circumstances if the procedures of the entity concerned so provide.
The fact that the Member State of residence has given effect to such a disqualification imposed by another Member State, should entail the consequence that the necessary measures are taken to penalise the act of driving a motor vehicle during the period of the disqualification under the laws of any Member State of the European Union in whose territory this may occur.
