(4) Töötaja käesoleva seaduse tähenduses on krediidiandja või -vahendaja heaks töölepingu või muu võlaõigusliku lepingu alusel tööd tegev füüsiline isik: 1) kelle tööülesannete hulka kuuluvad krediidi andmise või krediidi vahendamisega seotud tegevused, sealhulgas tarbija krediidivõimelisuse hindamise eest vastutamine, samuti nõustamisteenuse või muu krediidi andmise või krediidi vahendamisega seotud teenuse osutamisega seotud tegevused; 2) kes krediidi andmise või krediidi vahendamise, nõustamisteenuse või muu krediidi andmise või krediidi vahendamisega seotud teenuse osutamise käigus esindab tarbijaga suhtlemisel krediidiandjat või -vahendajat või krediidiagenti; 3) kes juhib või kontrollib käesoleva lõike punktis 1 või 2 nimetatud isikuid, kuid kes ei ole krediidiandja või -vahendaja juht., (4) For the purposes of this Act, a member of staff means a natural person who performs work for a creditor or a credit intermediary on the basis of an employment contract or another contract under the law of obligations and: 1) whose duties include activities related to the granting of credit or the intermediation of credit, including being responsible for the assessment of the consumer’s creditworthiness as well as activities related to the provision of advisory services or other services related to the granting of credit or the intermediation of credit; 2) who, in the course of the granting of credit or the intermediation of credit, the provision of advisory services or other services related to the granting of credit or the intermediation of credit, represents, in communicating with a consumer, the creditor or the credit intermediary or the credit agent; 3) who manages or controls the persons specified in clause 1 or 2 of this section, but who is not a manager of the creditor or the credit intermediary., defined within the scope of this Act, defineeritakse selle seaduse ulatuses
