  • § 3. Geneetiline muundamine (1) Geneetiline muundamine leiab aset, kui kasutatakse vähemalt ühte järgmistest meetoditest: 1) rekombinantse nukleiinhappe tehnoloogiat, millega väljaspool organismi tekitatakse geneetilise materjali muundatud kombinatsioone, mis viiakse peremeesorganismi, kus neid looduslikult ei esine, kuid nad on võimelised jätkuvalt replitseeruma; 2) väljaspool organismi valmistatud päriliku materjali organismi viimist; 3) kahe või enama raku ühinemisega muundatud geneetilise materjaliga elusrakkude saamist viisil, mis looduses ei esine. (2) Geneetiliseks muundamiseks ei loeta: 1) viljastamist väljaspool vanemorganismi; 2) konjugatsiooni, transduktsiooni, transformatsiooni või mõnda muud looduslikku protsessi; 3) indutseeritud polüploidsust. (3) Käesoleva paragrahvi lõikes 2 sätestatu kehtib tingimusel, et ei kasutata rekombinantse DNA molekule või geneetiliselt muundatud organismi käesoleva paragrahvi lõike 1 punkti 1 tähenduses.

Genetic modification (1) Genetic modification occurs through the use of at least one of the following techniques: 1) recombinant nucleic acid techniques involving the formation of new combinations of genetic material outside an organism, and their incorporation into a host organism in which they do not naturally occur but in which they are capable of continued propagation; 2) techniques involving the introduction into an organism of genetic material prepared outside the organism; 3) techniques where live cells with new combinations of genetic material are formed through the fusion of two or more cells by means of methods that do not occur naturally. (2) The following techniques are not considered to result in genetic modification: 1) in vitro fertilisation; 2) natural processes such as: conjugation, transduction, transformation; 3) polyploidy induction. (3) The provisions of subsection 2 apply on condition that the techniques do not involve the use of recombinant nucleic acid molecules or genetically modified organisms within the meaning of clause 1 of subsection 1 of this section.
