Käesoleva paragrahvi lõike 1 alusel kohustatud energiaettevõtja ostab alternatiivselt toodetud elektrienergia hinnaga, mis moodustab 90 protsenti kodutarbija põhitariifist, juhul kui Eesti Vabariigis alternatiivselt toodetud elektrienergia müügimaht ei ületa 2 protsenti eelmisel aastal Eesti Vabariigis kasulikult tarbitud elektrienergia kogusest.
