Põhiseaduse paragrahv 46 ei välista vaidluse lahendamise kohtueelset halduskorda, andes igaühele õiguse pöörduda avaldustega riigiasutuste, kohalike omavalitsuste ja nende ametiisikute poole. Põhiseaduse paragrahvi 13 lg. 2 kohaselt peab seadus kaitsma igaüht riigivõimu omavoli eest.
Ringkonnakohus leidis, et vastavalt ORAS-le ja sellest tulenevatele õigusaktidele on õigusvastaselt võõrandatud vara tagastamiseks ja kompenseerimiseks ettenähtud halduskord ja sellega seotud vaidlused lahendatakse halduskohtus.
