ESMi kui rahvusvahelise organisatsiooniga ühinemise leping allkirjastati Riigikogus 23. veebruaril 2012. Mehhanism alustas tööd oktoobris 2012. ESMi omanikud on euroala liikmesriigid ning mehhanismil on 700 miljardi euro suurune omakapital sh sisse makstud kapitali 80 miljardit eurot.
