Euroopa Kohtu koosseisus on üks kohtunik igast ELi liikmesriigist. Kohut abistavad 9 kohtujuristi, kelle töö seisneb Euroopa Kohtusse esitatud kohtuasjade kohta ettepanekute esitamises. Nad peavad seda tegema avalikult ja erapooletult. Iga kohtunik ja kohtujurist määratakse ametisse kuueks aastaks ning pärast ametiaja lõppu võib teda tagasi nimetada. ELi liikmesriikide valitsused otsustavad, kelle nad soovivad ametisse määrata.
Euroopa Kohtu kohtuniku kandidaadi, Euroopa Kohtu esimese astme kohtu kohtuniku kandidaadi ja kohtujuristide kandidaatide esitamisel tutvub Vabariigi Valitsus eelnevalt Riigikohtu esimehe ja õiguskantsleri arvamusega.
The Court of Justice is composed of 28 Judges and nine Advocates General. The Judges and Advocates General are appointed by common accord of the governments of the Member States after consultation of a panel responsible for giving an opinion on prospective candidates' suitability to perform the duties concerned. They are appointed for a term of office of six years, which is renewable. ... The Advocates General assist the Court. They are responsible for presenting, with complete impartiality and independence, an ‘opinion' in the cases assigned to them.
The Court of Justice shall be assisted by eight Advocates-General. Should the Court of Justice so request, the Council, acting unanimously, may increase the number of Advocates-General. It shall be the duty of the Advocate-General, acting with complete impartiality and independence, to make, in open court, reasoned submissions on cases which, in accordance with the Statute of the Court of Justice of the European Union, require his involvement.
