(1) Valdaja on isik, kelle tegeliku võimu all asi on. (2) Isik, kes valdab asja rendi-, üüri-, hoiu-, pandi- või muu selletaolise suhte alusel, mis annab talle õiguse teise isiku asja ajutiselt vallata, on otsene, teine isik aga kaudne valdaja. (3) Valdajaks ei ole isik, kes teostab tegelikku võimu asja üle teise isiku korralduste kohaselt tema majapidamises või ettevõttes.

(2) A person who possesses a thing on the basis of a commercial lease, residential lease, deposit, pledge or other relationship which grants the person the right to possess the thing of another person temporarily is a direct possessor, while the other person is an indirect possessor.
