(1) Nii vald kui ka linn on avalik-õiguslik juriidiline isik, keda esindavad seaduste ja omavalitsusüksuse põhimääruse alusel ning kehtestatud korras oma pädevuse piires volikogu, volikogu esimees, valla- või linnavalitsus ning vallavanem või linnapea või nende poolt volitatud esindajad.
