(1) Riigikaitseline ehitis käesoleva seadustiku tähenduses on Kaitseministeeriumi valitsemisala või Kaitseministeeriumi valitsemisala valduses olev ehitis, sealhulgas riigikaitseline tee.

(1) For the purposes of this Code, ‘construction work that serves national defence purposes’ means any construction work belonging to the sphere of administration or in the possession of the sphere of administration of the Ministry of Defence, including any road that serves national defence purposes.

(11) Lisaks käesoleva paragrahvi lõikes 1 sätestatule võib Vabariigi Valitsus määrata valdkonna eest vastutava ministri ettepanekul ja asjakohase ohuhinnangu alusel riigikaitseliseks ehitiseks ehitise, mille ainus eesmärk on riigi julgeoleku tagamine või hädaolukorra lahendamine.

(11) In addition to what has been provided for by subsection 1 of this section, the Government of the Republic may, on a proposal of the Minister in charge of the policy area and based on the relevant threat assessment, designate as ‘construction work that serves national defence purposes’ a construction work that exists solely to ensure national security or resolve an emergency situation.
