(1) Kaevandatav maavara on mäeeraldise piires arvel olev maavara, millest on maha arvatud kaevandamisloa taotluse seletuskirjas ning taotluse ja kaevandamisloa graafilistel lisadel piiritletud tervikutesse jääv maavara.
