(1) Haiglanakkus on nakkus, mida patsiendil ei olnud enne haiglasse või teise tervishoiuteenust osutavasse ettevõttesse minekut või mis ei ole eelmises sellises asutuses viibimise jääknäht, vaid on tekkinud patsiendil seal viibimise ajal või seal saadud ravi tagajärjel ja mille tunnused ilmnevad kas seal viibimise ajal või pärast sealt lahkumist.
