(5) Omakapitaliväärtpaber käesoleva seaduse tähenduses on: 1) käesoleva paragrahvi lõike 1 punktis 1 nimetatud väärtpaber; 2) igasugune vabalt kaubeldav märkimisõigus, vahetus- või tuletisväärtpaber, mis annab õiguse omandada käesoleva paragrahvi lõike 1 punktis 1 nimetatud väärtpabereid vahetamise teel või muu õiguse teostamisega, kui emiteeritava väärtpaberi emitent on ise väärtpaberi alusvaraks olevate väärtpaberite emitent või kuulub tema konsolideerimisgruppi., (5) For the purposes of this Act, an equity security is: 1) any security specified in clause 1 of subsection 1 of this section; 2) any freely transferable subscription right, convertible security or derivative security which grants the right to acquire securities specified in clause 1 of subsection 1 of this section by way of exchange or exercise of another right if the issuer of the security to be issued is the issuer of securities which are the underlying assets of the security or belongs to the consolidation group of the issuer., defineeritakse selle seaduse ulatuses, defined within the scope of this Act
