(1) Võlausaldaja satub vastuvõtuviivitusse, kui võlgnik ei saa täita oma kohustust võlausaldajast tuleneva asjaolu tõttu, eelkõige, kui võlausaldaja ei võta õigustamatult vastu talle tegelikult pakutud kohustuse kohast täitmist või keeldub õigustamatult kohustuse täitmisest, milleta võlgnik ei saa oma kohustust täita, või ei tee võlgniku kohustuse täitmiseks vajalikku muud tegu või koostööd võlgnikuga.
