  • (14) Biokütus käesoleva seaduse mõistes on kütus: 1) mille KNi esimesed neli numbrit on 1507–1518; 2) mis on valmistatud biomassist ja mille KNi kaheksa numbrit on 3824 84 00, 3824 85 00, 3824 86 00, 3824 87 00, 3824 88 00, 3824 91 00, 3824 99 55, 3824 99 80, 3824 99 85, 3824 99 86, 3824 99 92, 3824 99 93, 3824 99 96, 3826 00 10 või 3826 00 90. Biomassina käsitatakse põllumajanduslikke tooteid, kaasa arvatud taimseid ja loomseid aineid, metsandusest saadud toodete, jäätmete ja jääkide bioloogiliselt lagunevat fraktsiooni ning tööstuse- ja olmejäätmete bioloogiliselt lagunevat fraktsiooni; 2.1) mille KNi kaheksa numbrit on 2711 29 00, välja arvatud käesoleva lõike punktis 22 nimetatud kütus; 2.2) mille tarbimine on tõendatud biometaani päritolutunnistuse kasutamisega energiamajanduse korralduse seaduse § 327 mõistes; 3) mille KNi kaheksa numbrit on 2207 20 00 või 2905 11 00 ja mis ei ole sünteetilist päritolu.

  • (14) For the purposes of this Act, biofuel means fuel: 1) for which the first four digits of the CN code are 1507–1518; 2) which is produced from biomass, for which the eight digits of the CN code are 3824 84 00, 3824 85 00, 3824 86 00, 3824 87 00, 3824 88 00, 3824 91 00, 3824 99 55, 3824 99 80, 3824 99 85, 3824 99 86, 3824 99 92, 3824 99 93, 3824 99 96, 3826 00 10 or 3826 00 90. Agricultural products, including plant and animal substances, biodegradable fraction of products, waste and residues from forestry and the biodegradable fraction of industrial and municipal waste is deemed to be biomass; 21) for which the eight digits of the CN code are 2711 29 00, excluding fuel specified in clause 22 of this subsection; 22) the consumption of which has been proved by the use of a certificate of origin for biomethane for the purposes of § 327 of the Energy Sector Organisation Act; 3) for which the eight digits of the CN code are 2207 20 00 or 2905 11 00 and which is not of synthetic origin.
