The quality of the goods, their reputation and the existence of a trademark are among the factors to be considered in determining whether goods are similar, kaubad, mis on toodetud samas riigis, kuid ei ole identsed, vaid sarnanevad omaduste ning materjali poolest, täidavad samasugust otstarvet ning on omavahel kaubanduslikult asendatavad. Kaupade sarnasuse määramisel tuleb arvestada ka kaupade kvaliteeti, mainet ja kaubamärgi olemasolu.
