Kooselulepingu sõlmimisega kohustuvad kooselulepingu sõlminud pooled (edaspidi registreeritud elukaaslased) teineteist vastastikku toetama ja ülal pidama. Registreeritud elukaaslastel on teineteise suhtes võrdsed õigused ja kohustused. Nad korraldavad kooselu ühiselt, pidades silmas teineteise heaolu ning vastutades teineteise ees kooseluga seotud kohustuste täitmise eest.
For the purposes of this Directive, the definition of "family member" should also include the registered partner if the legislation of the host Member State treats registered partnership as equivalent to marriage.
By way of derogation from paragraphs 1(d) and 2 above, only the spouse, the registered partner provided for in Article 2(2)(b) and dependent children shall have the right of residence as family members of a Union citizen meeting the conditions under 1(c) above. Article 3(2) shall apply to his/her dependent direct relatives in the ascending lines and those of his/her spouse or registered partner.

While the EU term "partner in a registered partnership" (EU legislation) could have a wider meaning which encompasses same-sex and different-sex couples who registered their union (like in the French system), the only term used in the UK is "civil partner", which is more specific as it applies only to same-sex couples who registered their relationship with the competent authority. A registered partnership in the UK is a commercial partnership(Limited Liability Partnerships Act 2000). Under Directive 2004/38 a family member includes a registered partner if the legislation of the host Member State treats registered partnership as equivalent to marriage. A civil partnership under the 2004 Act is equivalent to marriage. [10.11.2016]
