Tööle ennistamise otsuse hilisema tühistamise ja hagi rahuldamata jätmise korral on tööandjal õigus tööleping lõpetada samal alusel, kusjuures vallandamiskuupäevaks loetakse töötaja viimane tööloleku päev selle tööandja juures.
A decision favourable to the person concerned shall be annulled if it was issued on the basis of incorrect or incomplete information and: - the applicant knew or should reasonably have known that the information was incorrect or incomplete, and - such decision could not have been taken on the basis of correct or complete information. The persons to whom the decision was addressed shall be notified of its annulment.
