In accordance with Commission Directive 94/46/EC of 13 October 1994 amending Directive 88/301/EEC and Directive 90/388/EEC in particular with regard to satellite communications (9), market entry for satellite personal communications space-segment operators can be restricted only on the basis of objective, transparent, proportionate and non-discriminatory selection criteria relating to the availability of scarce resources.
