Mootorsõiduki väljaspool teed joobeseisundis juhtimise õiguse piirangu mõõdupärasusega seoses selgitasite, et kõnealune keeld riivab isiku õigust vabale eneseteostusele, täpsemalt õigust juhtida mootorsõidukit joobeseisundis väljaspool teed: "Reeglina kasutatakse mootorsõidukit pikemate vahemaade läbimiseks, st olukorrad, kus mootorsõidukit kasutatakse näiteks vaid oma koduaia piires liikumiseks, on harvad. Samuti liigutakse mootorsõidukiga reeglina mööda teid, väljaspool teed sõitmine on pigem erand. Ka võimalus, et politsei hakkab massiliselt või tavapärase politseilise tegevuse käigus näiteks koduõuedes joobeseisundi olemasolu tuvastama, on ebatõenäoline. Kui aga tegemist oleks olulise isikukahju tekitamisega, siis õnnetuse asjaolude väljaselgitamisel oleks meie hinnangul selline tegevus vältimatu ka väljaspool teed.“
Isegi kui möönda joobes juhtimise väiksemat ohtlikkust inimtühjal põllul, on tõenäoline, et joobeseisundis juht sõidab põllult ühel hetkel koju, tootmishoonesse vms, kasutades liiklemiseks ka teed.
This Directive shall apply to the following road safety related traffic offences: (a) speeding; (b) non-use of a seat-belt; (c) failing to stop at a red traffic light; (d) drink-driving; (e) driving under the influence of drugs; (f) failing to wear a safety helmet; (g) use of a forbidden lane; (h) illegally using a mobile telephone or any other communication devices while driving.
Driving licences shall not be issued to, or renewed for, applicants or drivers who are dependent on alcohol or unable to refrain from drinking and driving.
People driving under the influence of alcohol are commonly referred to as drunk drivers, or drink-drivers. When charged with this as a crime, it may either be referred to as a DUI (Driving Under the Influence) or a DWI (Driving While Intoxicated), where a DUI is generally considered to be a lesser crime.
Inappropriate drinking and driving is defined normally as driver impairment in terms of: a driver with a blood alcohol content (BAC) above a prescribed legal limit which is punishable as a criminal offence, or as a driver with a (BAC) above a prescribed limit which is punishable by some form of administrative sanction such as a fine, or as a driver with a (BAC) below a prescribed limit but where the driver is judged to be impaired.
The laws should define offenses to include: driving while impaired by alcohol or other drugs (whether illegal, prescription or over-the-counter) and treating both offenses similarly; driving with a blood alcohol concentration (BAC) limit of .08 grams per deciliter, making it illegal “per se” to operate a vehicle at or above this level without having to prove impairment; driving with a high BAC (i.e., .15 BAC or greater) with enhanced sanctions above the standard impaired driving offense; ...
Alcohol-Impaired Driving. Drivers are considered to be alcohol-impaired when their blood alcohol concentration (BAC) is .08 grams per deciliter (g/dL) or higher.
