(1) Sundlitsents on lihtlitsents, mille annab valdkonna eest vastutav minister, kui kaitsealuse sordi omanik keeldub litsentsi andmast, isikule, kes on huvitatud kaitsealuse sordi kasutamisest ja on suuteline seda tegema: 1) kui kaitsealust sorti on vaja kasutada avalikes huvides või 2) kui litsentsiandja ei ole sordi kaitse alla võtmisest arvates kolme aasta jooksul kasutanud seda sorti ise ega andnud teisele isikule litsentsi selle sordi kasutamiseks.

(1) A compulsory licence is a non-exclusive licence issued by the minister responsible for the field in a situation where the owner of the variety protected by plant variety rights refuses to issue a licence to a person interested in using and able to use the variety protected by plant variety rights where: 1) the use of the protected variety is in the public interest, or 2) the licensor has not, within three years after plant variety rights were granted, used the variety or issued a licence for use of the variety to another person.
