  • (1) Finantseerimisasutus on käesoleva seaduse mõistes äriühing, mis ei ole krediidiasutus, kuid mille peamiseks ja püsivaks tegevuseks on osaluste omandamine või ühe või mitme käesoleva seaduse § 6 lõike 1 punktides 2–12 loetletud tehingu tegemine.

  • (2) Finantseerimisasutus käesoleva seaduse tähenduses on: 1) valuutavahetusteenuse pakkuja; 2) makseteenuse pakkuja makseasutuste ja e-raha asutuste seaduse tähenduses, välja arvatud makse algatamise ja kontoteabe teenuse pakkuja; 3) e-raha asutus makseasutuste ja e-raha asutuste seaduse tähenduses; 4) kindlustusandja kindlustustegevuse seaduse tähenduses (edaspidi kindlustusandja) ulatuses, milles ta pakub elukindlustusega seotud teenuseid, välja arvatud kogumispensionide seaduse tähenduses kohustusliku kogumispensioni kindlustuslepingutega seotud teenuseid; 5) kindlustusmaakler kindlustustegevuse seaduse tähenduses (edaspidi kindlustusmaakler) ulatuses, milles ta tegeleb elukindlustuse turustamisega või pakub muid investeerimisega seotud teenuseid; 6) fondivalitseja, välja arvatud kogumispensionide seaduse tähenduses kohustusliku pensionifondi valitsemisel, ja aktsiaseltsina asutatud investeerimisfond investeerimisfondide seaduse tähenduses; 7) investeerimisühing väärtpaberituru seaduse tähenduses; 8) krediidiandja ja krediidivahendaja krediidiandjate ja -vahendajate seaduse tähenduses; 9) hoiu-laenuühistu hoiu-laenuühistu seaduse tähenduses; 10) e-raha asutuse või makseteenuse pakkuja määratud keskne kontaktpunkt; 11) muu finantseerimisasutus krediidiasutuste seaduse tähenduses; 12) käesoleva lõike punktides 1–11 nimetatud isikust välisriigi teenusepakkuja Eesti äriregistrisse kantud filiaal.

  • (2) For the purposes of this Act, ‘financial institution’ means: 1) a foreign exchange service provider; 2) a payment service provider within the meaning of the Payment Institutions and E-money Institutions Act, except for a payment initiation service provider and an account information service provider; 3) an e-money institution within the meaning of the Payment Institutions and E-money Institutions Act; 4) an insurance undertaking within the meaning of the Insurance Activities Act (hereinafter insurance undertaking) to the extent that it provides services related to life insurance, except for services related to mandatory funded pension insurance contracts within the meaning of the Funded Pensions Act; 5) an insurance broker within the meaning of the Insurance Activities Act (hereinafter insurance broker) to the extent that it is engaged in marketing life insurance or provides other instrument-related services; 6) a management company, except upon managing a mandatory pension fund within the meaning of the Funded Pensions Act, and an investment fund founded as a public limited company within the meaning of the Investment Funds Act; 7) an investment firm within the meaning of the Securities Market Act; 8) a creditor and a credit intermediary within the meaning of the Creditors and Credit Intermediaries Act; 9) a savings and loan association within the meaning of the Savings and Loan Associations Act; 10) a central contact point designated by an e-money institution or a payment service provider; 11) another financial institution within the meaning of the Credit Institutions Act; 12) the branch of a foreign service provider registered in the Estonian commercial register, which is a person specified in clauses 1–11 of this subsection.
