§ 38. Ehitusluba (1) Ehitusluba annab õiguse ehitada ehitist, mis vastab ehitusloa andmise aluseks olevale ehitusprojektile. (2) Ehitusluba on nõutav käesoleva seadustiku lisas 1 nimetatud juhul. (3) Pädeval asutusel on põhjendatud juhul õigus anda ehitusluba või nõuda selle andmist ehitise kohta, mis ei sisaldu käesoleva seadustiku lisas 1. Ehitusloa võib anda, kaaludes ehitise ohtlikkust, mõju avalikule ruumile ja isikute õigustele ning võrreldes seda käesoleva seadustiku lisas 1 sisalduvate sarnaste näitajatega.

§ 38. Building permit (1) A building permit grants a right to build a construction work that corresponds to the building design documentation based on which the building permit is issued. (2) A building permit is required where this is mentioned in Annex 1 to this Code. (3) Where this is warranted by the circumstances, the competent authority is authorised to issue a building permit or to demand that a building permit be issued in respect of a construction work not included in Annex 1 to this Code. When considering whether to issue the building permit, the danger posed by the construction work and its impact on public space and on the rights of individuals is taken into account and a comparison is made with the similar indications provided by Annex 1 to this Code.
